One evening, at about 9:00 p.m., the complainant, Bob Boney, drove to a convenience store in Houston to refuel his Cadillac automobile. Appellant argues, in points one and two, the evidence was legally and factually insufficient to support the jury finding that a firearm was used or exhibited in points three and four, the trial court erred in allowing evidence of an extraneous offense and in points five and six, the trial court erred in overruling appellant's objection to an improper jury argument by the State. On appeal, appellant challenges his conviction in six points of error.
